Obtaining a leave of absence for domestic or sexual violence

  • You have the right to be absent from work for up to 26 weeks in any 12-month period if you are a victim of domestic or sexual violence.
  • If you have 3 months of continuous service, you are entitled to 2 days of paid leave during the same year for reasons of domestic violence or sexual violence.

Obtaining unpaid leave

  • You are entitled to up to 104 weeks of unpaid leave, provided you meet the following conditions:
    • You are an employee covered by the Act who has worked continuously for your employer for at least 3 months;
    • You are the victim of a criminal act causing serious psychological or physical injury;
    • You are unable to work at your job because of your injuries.
  • You are entitled to unpaid leave if you are an employee covered by the Act who has worked without interruption for at least 3 months and in the following cases:
    • Your minor child is reported missing in circumstances resulting from the commission of a crime. The maximum leave is 104 weeks;
    • Your presence is required with your child who has suffered serious injuries as a result of a criminal act, rendering him or her unable to carry out regular activities. The leave is for a maximum of 104 weeks;
    • Your spouse or child has died as a result of a criminal act. The maximum leave is 104 weeks.
